Your Two Cents
If you read the Dark Side's editorial of November 16, 2004,
you certainly have a clear picture of our opinion regarding
the matter of Cervin Morris - we called for his resignation.
Since we wrote the November editorial, additional facts
have come to light. At the time of his arrest on November
12, 2004, Cervin was on probation for a May 8, 2003, arrest
for drunk driving. Morris plead guilty (to the 2003
arrest) to a lesser charge of reckless driving while under
the influence and was sentenced to probation. His
blood alcohol level at the time of the arrest in 2003 was
.08 percent, the legal limit in California. However,
since he was under 21, it was unlawful for him to drive
with a blood alcohol level of anything over .01 percent.
Morris' current legal troubles include a violation of his
parole for the previous conviction, a misdemeanor assault
charge, and a felony assault charge. At the time of
his most recent arrest, according to witnesses, he was "highly
intoxicated." He was still underage when he was
arrested in November of 2004.
Morris and his attorney were in court on Friday, January
28, 2005, to ask for more time before his preliminary hearing.
Morris is attempting to raise money in order pay restitution
to his victims before his preliminary hearing.
During the Friday hearing, district attorney Hillary Dozer
advised Judge Joseph Lodge that Morris may bring in letters
of recommendation from the UCSB administration. Since
Judge Lodge is associated with the University, there could
be a conflict of interest requiring the judge to recuse
himself.
